What we collect through this site, how we use it, and the choices you have.
What this policy covers
This policy describes how Tony's Painting CA Inc. ("we" or "us") collects, uses, shares and protects personal information when you visit tonyspaintingca.com, request an estimate, book online, call, text or email us, refer someone to us, apply for a job, or hire us for painting work. By using the site or contacting us, you agree to this policy. If you do not agree, please do not use the site or send us information.
Information you give us
- Estimate and contact requests. Your name, phone number, email address, the property address, the project you describe, photos or documents you attach, and anything you tell us by phone, text or email.
- Online booking. The details you enter in the Housecall Pro scheduler, which Housecall Pro collects under its own privacy policy.
- Project records. If we work for you: the proposal, contract, change orders, colors and materials, invoices, payment records and walkthrough sign-offs. Card and bank details are handled by our payment processor and are not stored on this site.
- Referrals. If you refer someone, your name and contact details and the name and phone number of the person you refer. Send someone's details only if they have agreed to hear from us.
- Job applications. The information in your application, used only to consider you for a position.
Information collected automatically
Like most websites, this site uses cookies and similar technologies. Google Analytics 4 records how visitors use the site: pages viewed, approximate location, device and browser, and how you arrived. The Meta Pixel records site visits and actions such as submitting the estimate form or tapping a phone, text or booking link, so we can measure our advertising. The estimate form and referral form are provided by LeadConnector (GoHighLevel), the reviews widget by our review platform, and online booking by Housecall Pro. Each collects information under its own privacy policy when you use it. We may also receive your IP address, device identifiers and the page that referred you.
Information from other sources
We may receive your name and phone number from a customer or neighbor who refers you, property ownership information from public records when it is needed to prepare a proposal, reviews you post about us on public platforms, and reporting from our advertising partners.
How we use information
- To respond to you, schedule a site visit, and prepare estimates and proposals
- To perform painting work, document the job, and keep the records a licensed contractor is required to keep
- To communicate about your request and your project by phone, text and email
- To run the TONY250 offer and the Neighbor Referral program, including verifying that a project, customer or referral qualifies and paying rewards
- To send information about our services when you have agreed to receive it, which you can stop at any time
- To measure and improve the site and our advertising
- To detect, investigate and prevent fraud, abuse and misuse of our programs, and to enforce our terms and contracts
- To comply with the law, including contractor licensing, tax, lien and record-keeping requirements
Calls, texts and emails
When you submit a form, book online, call or text us, you agree that we may contact you by phone, text message and email about your request and any project we perform for you. Agreeing to receive text messages is never a condition of buying anything from us. Message frequency varies. Message and data rates may apply. Reply STOP to any text to opt out, or HELP for help. You can also ask us to stop calling or emailing you by contacting us at the details below. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
Cookies, analytics and advertising
Google Analytics and the Meta Pixel run when you visit the site. You can block or delete cookies in your browser settings, opt out of Google Analytics with Google's browser add-on, and manage ad preferences in your Meta account settings. The site does not currently respond to Do Not Track or Global Privacy Control browser signals; use the opt-outs above instead. Blocking cookies does not affect the estimate form or the phone links.
How we share information
We do not sell personal information. We share it only:
- With service providers that help us run the business: our form and CRM provider, scheduling, payment processing, email and text messaging, analytics and advertising platforms, and IT support. They may use it only to provide their service to us.
- With our insurers, accountants, attorneys and other professional advisers.
- To protect our rights, including to collect amounts owed under a contract and to record or enforce lien rights under California law.
- When the law requires it, in response to a subpoena, court order or lawful request, or to protect the safety of any person.
- If the business is sold, merged or reorganized, with the successor.
- With your permission, for example when you ask us to coordinate with your HOA, property manager or another contractor.
Our use of the Meta Pixel and Google Analytics may be considered "sharing" for cross-context behavioral advertising under California law. You can opt out as described above.
Photos of our work
We photograph surfaces before, during and after a project to document their condition and the work performed, and we keep those photos with the project record. We do not publish photos of your home or building, your name or your street address in our marketing without your permission. Photos you send us with an estimate request are used to prepare your proposal.
Reviews and testimonials
The reviews shown on this site come from Google and other platforms through a widget and are governed by those platforms' terms. If you review us there, your review is public. We may quote a public review on our site or in our marketing with your first name and city unless you ask us not to.
Referral program
If you refer someone, we use your details to credit and pay the reward and to contact you about it. We use the details of the person you refer only to respond to that referral, and only if you tell us they have agreed to be contacted. If we contact someone who did not agree, they can tell us and we will not contact them again.
How long we keep information
We keep estimate requests and communications for as long as needed to respond and to run our business. We keep proposals, contracts, change orders, photos, invoices and payment records for at least ten years after a project ends, because California allows construction-related claims to be brought for up to ten years and because contractor licensing and tax rules require records to be kept. Job applications are kept for the period required by employment law. Analytics and advertising data are kept for the periods set by those platforms.
Security
We use reasonable administrative, technical and physical safeguards to protect personal information, and we choose providers with security in mind. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. Please do not send card or bank details by text or email.
Your choices and rights
You can ask what personal information we hold about you, ask us to correct or delete it, or ask us to stop using it for marketing, by emailing info@tonyspaintingca.com or calling (619) 432-3821. We will verify your identity before acting on a request and respond within the time the law allows, generally 45 days. We may keep information we are required to keep by law or by a signed contract, and information needed to resolve disputes or enforce our agreements.
California residents
To the extent the California Consumer Privacy Act applies to us, California residents have the right to know the categories and specific pieces of personal information we collect and how we use and share them, to request deletion, to request correction, to opt out of the sale or sharing of personal information, and not to be treated differently for exercising these rights. In the past 12 months we have collected the categories described above: identifiers and contact details, commercial information about estimates and projects, internet activity on our site, approximate location, and professional information from job applicants. We do not sell personal information, and we do not knowingly sell or share the personal information of anyone under 16. You can submit a request or opt out of sharing using the contact details below, or authorize an agent to do so with your written permission.
Children
This site and our services are for adults. The site is not directed to children under 13 and we do not knowingly collect information from them. If you believe a child has sent us information, contact us and we will delete it.
Other websites
Links to other websites, including our booking, license verification, social and review pages, lead to sites we do not control. Their privacy practices are their own.
Changes
We may update this policy as our practices or the law change. The date at the top shows the latest version, and continued use of the site after a change means you accept it. Where a change materially reduces your rights, we will give notice on the site before it takes effect.
