These Terms and Conditions (“Terms”) govern your use of tonyspaintingca.com (the “Site”) operated by Tony’s Painting CA Inc. (“we,” “us,” or “our”), and your engagement of our painting services. By using the Site or engaging us for services, you agree to these Terms.
1. Services
Tony’s Painting CA Inc. is a California corporation providing residential and commercial painting services across San Diego County. We hold California Contractors State License Board (CSLB) License #803527, held continuously since the corporation was formed in January 2002. License classification: C-33 (Painting and Decorating Contractor).
All work performed by Tony’s Painting CA Inc. is governed by the signed written proposal or contract for that specific project, including any approved change orders. Where these Terms conflict with a signed contract, the signed contract controls.
2. Quotes and proposals
All quotes and proposals are based on the conditions observed during the on-site walkthrough. Pricing and scope are valid for the period specified in the written proposal (typically 30 days unless otherwise stated). Conditions discovered during work that were not visible at the walkthrough may require approved change orders, which will be documented in writing before additional work is performed.
3. Payment terms
Payment terms are specified in your signed contract or proposal. Standard residential terms typically require a deposit at contract signing, progress payments, and a final payment upon substantial completion. Commercial, HOA, and property management terms may differ based on the contract. Late payment may incur interest at the maximum rate permitted by California law.
4. Workmanship warranty
Written limited workmanship warranty terms are provided with qualifying proposals, contracts, or bid packages where applicable. Warranty coverage, exclusions, claim conditions, and remedies are controlled by the signed proposal, contract, approved change orders, and applicable written warranty document provided alongside the contract.
5. Cancellation
For residential home-improvement contracts in California, you have the right to cancel within three (3) business days after signing, as required by the California Business and Professions Code. Cancellation must be in writing. After the cancellation period, cancellation terms are governed by your signed contract.
6. License and insurance
Tony’s Painting CA Inc. is licensed by the California Contractors State License Board (CSLB License #803527) and carries general liability insurance and workers’ compensation insurance. A Certificate of Insurance is available to clients upon request before work begins. License verification: cslb.ca.gov.
7. Property access and protection
By engaging our services, you authorize Tony’s Painting CA Inc. and our crew to access the property described in the signed contract during the scheduled work window. You agree to provide reasonable access, including for inspection, preparation, painting, and final walkthrough. We will protect furniture, fixtures, flooring, and adjacent surfaces as specified in your scope.
8. Use of the Site
The Site is provided for informational purposes. Content on the Site (text, photos, design, and structure) is owned by Tony’s Painting CA Inc. or licensed to us. You may not copy, reproduce, distribute, or republish content without written permission, except for personal, non-commercial reference.
9. Comparison and reference to other companies
The Site includes comparison content referencing other painting companies (CertaPro Painters, Five Star Painting, 360° Painting). Claims about other companies are sourced from their public websites or other publicly available sources at the time of writing and are dated. Tony’s Painting CA Inc. is not affiliated with any of these companies. Their service terms, warranties, and offerings may vary by franchise location and may change after the date this content was published.
10. Reviews and testimonials
Customer reviews and testimonials displayed on the Site are real and unedited. Owner responses are verbatim. We do not pay for reviews, generate fake reviews, or alter customer review text.
11. Limitation of liability
To the maximum extent permitted by California law, the liability of Tony’s Painting CA Inc. arising out of or related to Site use is limited to the amount you have paid us, if any, in the preceding 12 months. The liability of Tony’s Painting CA Inc. arising out of painting services is governed by the signed contract and the written limited workmanship warranty.
12. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising out of these Terms or related to services provided by Tony’s Painting CA Inc. will be resolved in the state or federal courts located in San Diego County, California.
13. Changes to these Terms
We may update these Terms periodically. The current version is posted at this URL with the “Last updated” date above. Continued use of the Site after a change indicates acceptance of the updated Terms.
